Terms of Service Agreement

1. Introduction

These Terms of Service ("Agreement" or "Terms of Service") govern your use of the Fluxio mobile application ("Fluxio" or "App" or "Services"), developed and operated by Murat Göğebakan, a sole proprietorship (“şahıs şirketi”) registered in Bursa, Turkey ("Provider", "we", "us", or "our"). By accessing or using Fluxio, you agree to be bound by these terms. If you do not agree to these Terms, please do not use Fluxio.

2. Terms and Binding Effect

This Agreement constitutes a legally binding contract between you and Murat Göğebakan regarding your use of Fluxio. We reserve the right to amend these Terms of Service at our sole discretion without prior notice. Updated terms will be posted in-app or on our website, and your continued use of Fluxio after any modifications constitutes acceptance of those changes.

3. Privacy

To deliver the Services effectively, we may require certain information from you. Your privacy is important to us. We handle your information according to our Privacy Policy. Please refer to the Privacy Policy for details on how your information is collected, used, and managed.

4. Age of Users

Users between the ages of 13 and 18 require parental or legal guardian consent to utilize Fluxio. Parents can provide and verify consent through the app or via an authorized third-party provider. We advise parents to monitor their child's online activities and use of Fluxio. We disclaim responsibility for any activities conducted by individuals under the age of 13, with or without parental permission. By providing consent for your child to use Fluxio, you agree to these terms governing their usage.

5. Description of Services

Fluxio is a mobile application providing AI-powered photo and video editing features.

6. Your Obligations

By using Fluxio, you agree to:

  • Use Fluxio only through authorized means.
  • Comply with applicable laws and these Terms of Service.
  • Abstain from unlawful activities.
  • Comply with any requests from us regarding your behavior.
  • Refrain from cheating, hacking, or disrupting the App.
  • Avoid transmitting viruses or malicious code.
  • Maintain the integrity of the App and respect other users' privacy.
  • Use your own payment method for transactions within the App.
  • Not use Fluxio's trademarks or intellectual property without authorization.

We reserve the right to suspend or terminate your access to Fluxio if you fail to comply with these obligations or engage in unlawful activities.

7. Payment Obligations

All purchases made through Fluxio are final unless required by law or by the policies of the platform you used for payment (e.g., Apple App Store). Upon account termination, unused services or features are forfeited without compensation.

8. Prohibited Uses

  • Unauthorized access to Fluxio.
  • Use for illegal purposes.
  • Modifying, reverse-engineering, or interfering with the App.
  • Unauthorized transfers or sales of features or content.
  • Use of third-party software to modify or interfere with Fluxio.
  • Hosting or providing unauthorized access to Fluxio.

Violation of these prohibitions may result in account termination and legal action.

9. Use of Software and Content

  • You are responsible for any content you provide or transmit through Fluxio and must not infringe upon third-party rights.
  • We grant you a limited, non-exclusive license to use Fluxio for personal, non-commercial purposes. Any unauthorized use is prohibited.
  • We reserve the right to limit, suspend, terminate, modify, or delete accounts or access if users violate these Terms or engage in illegal or improper use.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of Turkey. Any dispute arising out of or related to these Terms or your use of Fluxio shall be exclusively settled in the courts of Bursa, Turkey.

1. Purpose and Data Controller

This Privacy Policy explains how Murat Göğebakan, a sole proprietorship (“şahıs şirketi”) registered in Bursa, Turkey ("we", "us", "our") collects, uses, and protects your information in connection with the Fluxio mobile application ("Fluxio", "App", or "Services"). 2. Scope

This Privacy Policy applies to Personal Information processed by us in the course of providing Fluxio, including through our app, website, or customer support. By using Fluxio, you agree to this Privacy Policy and Terms of Service. Please do not use Fluxio if you do not agree with our policies.

3. Types of Personal Information We Collect and How We Use It

The types of Personal Information we collect and how we use it are limited and specific to the operation of Fluxio:

  • Automatically Collected Data: We collect basic usage information through logs, analytics tools, and cookies. This includes device information, operating system, app usage statistics, and error reports. This helps us monitor performance, improve the app, and ensure stability.
  • Image and Content Processing: When you use the app’s image generation or editing features, the photos you submit are temporarily processed on our servers and with third-party AI providers (such as OpenAI or Google Gemini). We do not keep the images you upload after processing. However, the generated output content is stored securely on a third-party server for up to one week to enable features such as download history, user support, and abuse prevention. After this period, generated content is deleted automatically.
  • Support and Contact: If you contact us for support or feedback, we may keep your email address and correspondence for customer service purposes.

We do not require user registration or collect personal identifiers such as names or email addresses for regular app usage.

Photo/Video Processing

When users apply AI effects, the selected photo is sent securely to our servers for temporary processing. It may be shared with trusted third-party AI providers solely for generating the requested effects. The photo is used only momentarily and is not stored or retained afterward.

Ad Networks and Social Media Widgets

Fluxio may feature advertising or social media sharing features. Third-party services may collect information as governed by their own privacy policies.

4. Disclosure of Your Information

We do not share your personal information or content with other users or make it publicly available within the app. Your data is not sold or rented to any third parties.

Information may be shared with trusted third-party service providers (such as cloud infrastructure or AI model providers) strictly for the purpose of processing images and operating app features. These third parties are not permitted to use your data for any other purpose.

We may share aggregated, non-identifiable analytics data with our service partners to help improve the app. No personal or image data is included in such reports.

5. International Transfer

Personal Information may be stored on servers located in Turkey or other jurisdictions, depending on our third-party providers.

6. Opt Out (Right to Restrict Processing)

You may withdraw your consent at any time and request to restrict processing of your Personal Information by opening an in-app support ticket or contacting gogebakan.cagan@gmail.com.

7. Rights of Access, Rectification, Erasure, and Restriction

You have the right to request access to, rectification, or erasure of Personal Information, or restriction of processing, as provided by applicable law.

8. Data Retention

We retain Personal Information as long as you use Fluxio or as necessary to fulfill the purposes for which it was collected.

9. Security of Your Information

Personal Information is stored on secured servers and protected by industry-standard protocols and procedures.

10. Children's Privacy

Fluxio is not directed to children under 13, and we do not knowingly collect personal information from children under 13. Parents can contact gogebakan.cagan@gmail.com with questions.
